Charles Fischer Administrator No. 1 Share Posted April 17 Too early to draw conclusions, but one subscription site is cautious, while the other is already looking to replace him in the portal. Many are saying it was simply a mistake, and I can relate. When I was very young...during a rainstorm in downtown Eugene I was turning and someone walked in front of me (I could not see them due to the downpour) and he shook his fist at me and walked on after I bumped him with my bumper. He was going to press charges, and the police just fried me in our meeting. (Interrogation) They decided after listening to my story that they/the victim would not go further with this. I was young and did not know that when something like this happens--you pull over and meet with the affected party. If you don't...it is hit-and-run. Anyone who knows me knows I would never do that, but I was young, did not know the law, etc. This might be case? 2 Mr. FishDuck
Charles Fischer Author Administrator No. 2 Share Posted April 17 As a corner--he had superb athletic skills, and I thought had a high upside at Oregon. He was verballed to LSU, but we turned him in the recruiting process of which I thought was a big win. We find out the facts later! kirklandduck Moderator No. 5 Share Posted April 17 Well that would explain the arrest. But no details on the circumstances, I'm going to wait for those to come out before forming an opinion.

Haywarduck No. 8 Share Posted April 17 In a split second a situation changes, and two people are in the wrong spot. In another moment somebody, or two people make poor choices. Seems tragic all around, and we don't know the whole dynamic, but I'll wait to see exactly what happened. Definitely a turn nobody wanted to take. When I think back, I could have been in a similar situation too many times, but was lucky!

I heard this afternoon the deceased was a homeless man that confronted the player with a weapon (hammer), the kid hit him with his car, possibly in self defense, fled home and called his coach, and that alcohol was involved. Still a lot to unpack. Edited April 18 by JabbaNoBargain

As you said lots more info to come out most likely.
Autzen Magic No. 12 Share Posted April 18 According to the Register-Guard: "Austin was arraigned at the jail on Wednesday and was charged with failure to perform duties of a driver to seriously injured persons." I have absolutely NO inside information, but the fact that it does not appear that Austin was charged with DUI, MIP or Manslaughter leads me to believe that the Eugene police believe his only crime was not remaining at the scene. His next court appearance is May 22, but I expect that we'll get more details from the UO/his attorney/the press in the next few days. It wouldn't surprise me if a statement is made late tomorrow, to limit the distribution of the story by national media to over the weekend and not during the busier weekday news cycle. Charles Fischer Author Administrator No. 13 Share Posted April 18 It makes me ill that a national news agency was reporting this on their front page. Washington Waddler Moderator No. 17 Share Posted July 9 The measure 11 applied law would seem to be Aggravated vehicular homicide which doesn’t seem likely if an element of self-defense is involved that disputes a charge of indifference to human life. Autzen Magic No. 18 Share Posted July 9 Daylen Austin's court appearance has been delayed a couple of times because "the state's discovery and the defense investigation are ongoing and incomplete." A court appearance is currently set for Thursday, July 11. Because that is only two days away and there has been no request for a further postponement (at least none that has been entered by the court clerk as of the time of this posting), I believe that we'll learn more this week (but I would not be shocked by another postponement). 1
Just Ducky No. 19 Share Posted July 9 As is the case on many events my head is buried deep in the sand on this one. First I’ve heard of it. Interesting to see the outcome for sure. I’ve been attacked by a homeless person, loaded on something, in OC and trust me it is a scary moment to say the least. I reported it to a Police officer a few minutes later and her comeback was. Do you want to press charges? I almost laughed at her. Told her I just wanted to inform her that it happened. My point is the Police officer wanted nothing to do with it, nor do the courts, she just wanted to be on her way. Sad situation for sure but it’s the way of the world in the Willamette Valley. Not just the Willamette Valley, I’ve had all sorts of encounters coast to coast. Drove my wife to drop something off for work at a building on the east side (PDX), parking lot looked clear, I waited for her, just out of sight, maybe 100 feet from the front door, in broad daylight mind you. Somewhere between the car and the door of the building, an individual with a face painted red, started getting in her space and menacing her, a bystander (large dude) intervened by yelling “back the F off” multiple times. Point of my story, I can empathize. One slight twist and the red faced person could have been killed, easily. Completely unknown if they actually meant to harm my wife, but who wants to find out?
